Ben Sassé Quoted in The Plain Dealer on Ohio Supreme Court’s Hewitt Decision

Ben Sasse was quoted in The Plain Dealer in connection with his recent win before the Ohio Supreme Court in Hewitt v. L.E. Meyers Co. The Court ruled that the exception to workers’ compensation immunity allowing employees to sue employers for the “deliberate removal” of an “equipment safety guard” does not apply to injuries stemming from an employer’s alleged failure to instruct an employee to use available personal protective items.

Ben said the Court’s decision was consistent with the state legislature’s intent to narrow the scope of worker injury cases, and commented that “Personal items like gloves and sleeves that are in an employee’s control are not equipment safety guards.”
