Brian Jackiw, Bill Stavole, and Jason Torf Present to Groups on Bankruptcy Strategies and Issues

On February 22, Brian Jackiw and Bill Stavole presented a webinar on Assignments for the Benefit of Creditors (ABCs) and Receiverships – liquidation schemes which provide an alternative to bankruptcy – to the NACM Connect constituency, which incorporates a number of states and geographical regions. Brian and Bill explained both of these procedures and highlighted some of the uncertainties that go along with ABCs and Receiverships. They provided information as to how creditors can best protect their interests while navigating both of these procedures.

Last week, Brian Jackiw and Jason Torf presented “Understanding a Small Business Reorganization Under New Subchapter V of the Bankruptcy Code” to two groups in San Antonio, Texas. Brian and Jason addressed attendees of the Home Centers and Building Products National Credit Group industry meeting, and Brian presented at the Consumer Products National Credit Group industry meeting. Both groups are composed of credit professionals from various national companies in their respective industries. The presentations addressed the Small Business Reorganization Act (SBRA) and its impact since the law became effective in February 2020. Brian and Jason explored not only the changes in the law and how it has affected bankruptcy filings, but also how it has, in many instances, negatively impacted a creditor’s rights and remedies. They also discussed a myriad of cases and conflicting decisions when interpreting the SBRA’s statutes.
