Courtenay Jalics Speaks at ABA Joint Regional CLE Program

On February 1, Courtenay Jalics spoke at the American Bar Association’s 2024 Environmental & Energy, Mass Torts, and Products Liability Litigation Committees’ Joint Regional CLE Program in Avon, Colorado. As a panelist in “An Ethics Conundrum: The Lawyer-Witness,” Courtenay discussed the practical and ethical issues confronting attorneys when the roles of advocate and witness are combined and when the in-house client or outside counsel is called as a fact or expert witness. The panelists addressed questions including the model rules that are implicated with a lawyer-witness, the limitations of the attorney-client privilege and work product protections, and how to ethically and simultaneously advocate for and protect the client during the discovery process.
