Tucker Ellis Obtains Dismissal with Prejudice for Infant Formula Manufacturer in False Advertising Class Action

On March 20, Tucker Ellis obtained dismissal with prejudice of all claims brought against Mead Johnson Nutrition Company and Mead Johnson & Company, LLC (Mead Johnson) in a purported nationwide class action brought in the United States District Court for the Northern District of California. In Lopez v. Mead Johnson Nutrition Company, et al., the plaintiff alleged that the packaging of Mead Johnson’s baby formula did not disclose the presence of heavy metals and was therefore misleading under California law. The court previously granted Mead Johnson’s motion to dismiss without prejudice and gave the plaintiff an opportunity to amend. Upon review of the amended complaint and Mead Johnson’s briefing, the court found that the plaintiff failed to cure the legal deficiencies and granted dismissal with prejudice.
