Michael Anderton

Michael Anderton is Counsel in the Cleveland office of Tucker Ellis & West LLP and is a trial lawyer with a wide variety of experience. Michael defends pharmaceutical and medical device companies in product liability litigation, including state-coordinated and federal multi-district litigation throughout the country. He also has extensive experience counseling and representing a wide variety of businesses – service providers, real estate investment firms, and a broad spectrum of manufacturing businesses and Ohio public entities – in business litigation, employment litigation, and labor law and related litigation. This includes commercial disputes and claims involving non-competition agreements, trade secrets, and business-related torts, as well as employment lawsuits involving alleged discrimination, wrongful discharge, and compliance with federal and state employment laws. Michael also counsels and represents various benefit and pension plans and plan administrators in litigation of claims arising out of ERISA-covered plans. He has extensive traditional labor law experience representing employers at the National Labor Relations Board and Ohio’s State Employment Relations Board, and he regularly negotiates, and counsels employers regarding compliance with, collective bargaining agreements.

Michael has significant experience in discovery of Electronically Stored Information in large, complex litigation. He assists clients with all aspects of complex electronic discovery, including document management strategies and policies, document preservation and litigation holds, and all aspects of discovery of ESI – collection, processing, development of search criteria and techniques, responsiveness review, privilege review, and production of documents. He has significant experience managing large teams of attorneys and third party vendors in complex review and evaluation of large collections of ESI.

Michael has tried cases in federal and state courts in Ohio and before the National Labor Relations Board and Ohio’s State Employment Relations Board, and he has arbitrated dozens of cases on behalf of private and public sector clients. In addition, he has extensive experience mediating cases in federal and state court and before the EEOC, Ohio Civil Rights Commission, and other administrative agencies, and has resolved many cases favorably for his clients through mediation.
