Unlike fictional civil litigation, the majority of cases end in settlement. This means that all attorneys – regardless of their level of experience – should be well versed in settlement strategy. Settlement negotiations involve knowing the case inside and out; being able to understand and anticipate opposing counsel’s position; understanding the law, jurisdiction, and court in play; arguing the strengths of the case while also recognizing the weaknesses; seeing the case through from start to finish; and substantively engaging with opposing counsel. Frequent settlement negotiations also allow you to build professional relationships that will help you and your clients down the road.
