Traci Shafroth practices in the area of complex commercial litigation, focusing primarily on defending pharmaceutical and medical device manufacturers in personal injury litigation, defending manufacturers in product liability litigation, and appellate matters.

She has served on national and local counsel teams defending manufacturers of prescription medications and medical devices in personal injury and wrongful death actions in jurisdictions across the country. She has experience in all aspects of litigation, from pleading challenges through trial.

In addition to her trial-related work, Traci assists clients with post-trial proceedings and appeals in the California courts, including post-trial motion practice and appellate briefing in cases involving a variety of consumer and medical products.

Traci has also handled complex business litigation for clients in the financial, software, manufacturing, and private equity industries, defending clients against allegations of fraud, breach of fiduciary duty, breach of contract, and a variety of business torts.

A former certified public accountant, Traci started her career at Arthur Andersen LLP, where she spent seven years as an auditor and business consultant. Traci worked in Andersen’s offices in the Bay Area and Sydney, Australia, serving both publicly traded and privately held clients in diverse industries including finance, hospitality, entertainment, and municipal government. With more than a decade of experience serving clients in a variety of business-advisory roles, Traci brings to her litigation matters a distinctive perspective that greatly enhances her ability to find creative solutions for clients.

A native of St. Louis, Missouri, Traci settled in the San Francisco Bay Area after spending several years on both coasts. She enjoys a good book, cooking dinner with her youngest son, snowboarding with her eldest, and beating her in-laws at Scrabble.

  • Defended a pharmaceutical company in a jury trial alleging failure to warn of potential bleeding risk from an anticoagulant prescription medication, obtaining defense verdict
  • Defended an elevator company in a personal injury jury trial involving a sudden elevator stop, obtaining defense verdict; currently representing the elevator company in a related appeal
  • Currently defending a pharmaceutical company in federal multidistrict litigation and a state coordinated proceeding alleging failure to warn of potential bleeding risk from an anticoagulant prescription medication
  • Currently defending a pharmaceutical company in federal and state courts throughout the country in cases alleging personal injury from the use of diabetes medication
  • Currently defending a consumer products company in federal and state court proceedings alleging cancer resulting from the use of products containing talcum powder
  • Currently representing a medical device manufacturer as appellate counsel in an appeal involving an allegedly defective gastric band
  • Served as appellate counsel for a foreign-manufacturer respondent in an appeal involving failure to serve summons within statutorily designated time limit
  • Currently defending medical device manufacturers in litigation regarding alleged defects in implantable mesh devices
  • Defended a pharmaceutical company in product liability actions alleging cancer resulting from the use of diabetes medication in a California Coordinated Proceeding involving more than 900 cases
  • Defended a pharmaceutical company in product liability actions alleging cancer, infectious disease, and neurological injuries resulting from medication for autoimmune diseases at the trial and appellate levels in federal and state courts around the country
  • Defended pharmaceutical companies in a product liability coordinated proceeding alleging personal injuries caused by the generic drug metoclopramide, successfully obtaining stipulated dismissal for all clients 
  • Defended tobacco company in $525 million action alleging fraudulent conveyance and alter ego claims related to asbestos liability
  • Defended a Fortune 500 financial services company in litigation in California state court alleging breach of fiduciary duty, unfair competition, intentional interference, breach of contract, and related claims
  • Defended a private equity firm and its software portfolio company in litigation in New York and Massachusetts state courts alleging fraud, breach of contract, and promissory estoppel arising out of corporate transactions
  • Represented a private equity firm and software portfolio company in an accounting arbitration of a net working capital dispute, securing substantial client award
