SHRM Quotes Carl Muller on Hiring Practices During COVID-19

On April 14, the Society for Human Resource Management (SHRM) quoted Carl Muller on the challenges employers face during the COVID-19 pandemic, particularly in the context of whether employers can test job applicants for the coronavirus.

In the article, Carl advised employers to use caution when rescinding job offers. Job candidates who test positive with only mild symptoms are unlikely to be considered to have a disability under the Americans with Disabilities Act (ADA), but employers may find themselves in violation of the ADA if they refuse to hire a candidate who tests positive and is hospitalized “with significant symptoms and whose breathing is impaired for many months during a lengthy recovery[. They] would likely be considered to have a ‘disability’ under the ADA,” Carl said.
