Jane Davidson was among the attorneys and legal technologists asked by Legaltech News to make predictions for the privacy world in 2021.
Jane commented, "The shift to remote schooling created a surge in underage consumers using education technology, gaming, and other youth-targeted apps. Most comprehensive privacy laws include special provisions for children under 13 or 16, and several states, the U.S. federal government, and VP-elect Kamala Harris have long expressed interest in protecting kids' privacy. The California Consumer Privacy Act even reverses its Opt-Out framework, requiring children under 16 to Opt-In. Zoom and TikTok were the poster-children for 2020 privacy concerns. Following the FTC's action against YouTube, 2021 will feature politically popular enforcement actions for failure to comply with children’s privacy laws."
