Federal Court Dismisses All Claims Against Tucker Ellis Client in Purported Nationwide Class Action

On July 26, the U.S. District Court for the District of Minnesota dismissed all claims in a purported nationwide class action against Tucker Ellis client Target Corporation based on the “gentle” and “hypoallergenic” representations on one of its make-up remover wipe products, finding that most of the statements on the label are non-actionable puffery. (McAteer v. Target Corp., No. 18-349.)

Among the Tucker Ellis attorneys defending Target in this litigation were John Lewis, Jennifer Mesko, and Karl Bekeny.
