On September 1, Cliff Mendelsohn spoke at the 2021 NAFA Fleet Management Association Institute & Expo in Pittsburgh. Cliff discussed recent trends in nuclear verdicts in motor vehicle accident litigation, plaintiffs’ strategies for using negligent entrustment claims to achieve nuclear verdicts, and steps fleets can take to tell their “Safety Story” to defend negligent entrustment claims. In particular, he stressed the importance of companies taking time outside of the litigation context to identify the individuals and documents necessary to develop a complete and cohesive story about what they do at each stage of their fleet operations to focus on safety. That way, they are in the best position to defend negligent entrustment claims when asserted.
