Law360 quoted Dan Messeloff in “How Employers Can Avoid Bias in Recession-Driven Layoffs.” As many companies consider reductions in force in anticipation of a possible recession in 2023, they risk claims of discrimination and unlawful termination on the basis of employees’ gender, race, or other protected classes. Dan commented on the need for employers to analyze their workforce every time that jobs are cut – no matter how few – in order to spot and avoid potential discrimination issues before they arise.

“Regardless of the number of employees at issue, that kind of analysis should be done no matter what,” Dan said. “Even if it’s two people, and those two people happen to be the only members of a minority group within a department, that is something that the company should be aware of.”
