California Enacts New Rules on Electronic DiscoveryJuly 2009 By: Dylan M. Carson On June 29, 2009, California law on discovery of electronically stored information (ESI) was changed with the enactment of the Electronic Discovery Act. The new Act updates the Code of Civil Procedure (CCP) by establishing duties and responsibilities for parties requesting and producing ESI. The new amendments align California with other states and the federal courts in formulating procedural rules regarding discovery of ESI.
