Tucker Ellis Secures Trial Victory for J&J Unit McNEIL-PPC, Inc. in Tylenol Suit

November 2014

On November 10, 2014, a California federal jury found that Tucker Ellis client McNEIL-PPC, Inc. – a Johnson & Johnson unit – was not negligent in either manufacturing or testing a batch of Children’s Tylenol in 2008. The suit was filed in 2011 by the mother of a boy who died in 2009 after he ingested the medicine, and claimed that it was contaminated by deadly bacteria. The jury rejected the plaintiff’s claims and found that McNEIL’s manufacturing processes related to Children’s Tylenol were responsible and appropriate. Tucker Ellis was part of a national team that included Butler Snow LLP and Patterson, Belknap, Webb & Tyler LLP.
