On March 19, Tony Petruzzi and Vicky Vance spoke at the Cleveland Metropolitan Bar Association’s CLE, “Health Care Fraud: What Every Health Care and Criminal Attorney Should Know.”

Tony discussed important things to consider when conducting healthcare fraud investigations, including corporate criminal liability and the responsible corporate officer doctrine, Upjohn Warning/attorney-client privilege considerations in internal investigations, and Fifth Amendment concerns in healthcare fraud matters. Vicky provided an overview of the five major criminal/regulatory healthcare statutes – Stark, Anti-Kickback, False Claims Act, Civil Monetary Penalties, and the Exclusion Statute – and touched on the top five healthcare transactions that draw criminal or regulatory scrutiny.
