Tucker Ellis Takes Sham Litigation Argument to First Circuit

Pat Pascarella argued before the First Circuit in Puerto Rico Telephone Co. v. San Juan Cable LLC as reported in Law360 in "Puerto Rico Telecoms Take Antitrust Fight to 1st Circ." On May 2, Puerto Rico Telephone Co., a subsidiary of América Móvil, asked the First Circuit to overturn a lower court ruling relating to alleged sham litigation brought by its competitor to delay its entry into internet protocol-based television in Puerto Rico.

"OneLink wasn't seeking to redress any grievances,” Pat argued. “They were seeking a delay."

Pat was joined by Ben Sassé and Nate Newman in preparing the appeal to the three-judge panel.
