Brian W. FitzSimons

Brian FitzSimons is a Partner in the Cleveland office of Tucker Ellis & West LLP. He is a tax attorney who also handles a wide variety of corporate and business transactional assignments including mergers and the purchase and sale of corporate businesses. Brian has had extensive experience in numerous aspects of federal, state, local and international tax law and has been involved with clients ranging from multinational corporations to individual taxpayers with respect to tax planning and counseling, the tax aspects of business transactions, and representing taxpayers in federal, state and local tax audits, appeals and litigation before the Ohio Board of Tax Appeals, the Ohio Supreme Court and the United States Tax Court.

Mr. FitzSimons has represented numerous clients in the oil and gas field and the healthcare field. With respect to the latter, he has structured joint ventures among healthcare institutions, obtained tax-exempt status for hospitals, assisted living facilities, private foundations and other charitable organizations. Brian also represents, as general counsel, many privately-held manufacturing and professional service businesses both domestically and with respect to international joint ventures in, or with respect to, such places as Brazil, the United Kingdom, Germany, China, Chile, Vietnam and Canada. He has written A Primer on Tax Aspects of U.S. Business and Investment Activities by Foreign Persons. He has also negotiated numerous employment contracts and severance contracts for presidents and chief executive officers of Fortune 500 companies and other corporations. In conjunction with one of the firm's clients, Brian has been involved for more than 20 years in tax and business planning for some of the most famous athletes in the world.

Brian has served as General Chairman of the Cleveland Tax Institute and has lectured at that Institute for more than 20 years on a wide variety of tax subjects. Mr. FitzSimons has been listed in Best Lawyers in America for more than 10 years.
